项目内容

Project Content

为推进浦东新区司法局法治政府建设，强化政府法制工作力量，购买律师服务。

1、协助提供区司法局民事领域合同法制审核意见；

2、协助重大行政决策的意见征询、专家论证、合法性审核意见；

3、协助提供行政处罚法制审核服务；

4、协助提供行政规范性文件合法性审查、评估清理；

5、协助提供政策文件公平竞争审查、评估清理；

6、协助疑难复杂信访案件的咨询和接待；

7、协助区司法局起草行政复议答复书；

8、协助区司法局起草政府信息公开答复意见；

9、参与其他专项工作合法性审查、研提方案、法律咨询等非诉讼法律事务；

10、担任区司法局行政应诉案件代理人、提交代理意见、参与庭审等诉讼法律服务；

11、交办的其他相关任务。

To advance the rule-of-law government construction of Pudong New Area Judicial Bureau and strengthen legal support capabilities, we purchase lawyer services. The services include:

1. Provide legal review opinions on contractual matters in civil affairs for the District Judicial Bureau;

2. Assisting in opinion solicitation, expert demonstration, and legality review of major administrative decisions;

3. Offer legal review services for administrative penalties;

4. Assisting in legality review, evaluation, and cleanup of administrative normative documents;

5. Perform fair competition reviews and compliance assessments for policy documents;

6. Provide consultation and reception services for complex petition cases;

7. Assist the District Judicial Bureau in drafting administrative reconsideration response documents;

8.Assist the District Judicial Bureau in drafting the reply opinions on government information disclosure;

9. Participate in non-litigation legal affairs including compliance reviews, proposal development, and legal advisory services for specialized projects;

10. Serve as litigation counsel for administrative litigation cases, submit legal opinions, and attend court proceedings;

11. Execute other assigned tasks.

Negative Conditions

（一）在中介集市报名前3个月内存在1次记入一般不良诚信档案行为的；

（二）在中介集市报名前1年内存在2次记入一般不良诚信档案行为的；

（三）在中介集市报名前2年内存在1次记入严重不良诚信档案行为的；

（四）在中介集市报名后中介服务合同签订前，存在记入一般或者严重不良诚信档案行为的

I. One recorded minor bad credit behavior within 3 months before registration in the intermediary market.

II. Two recorded minor bad credit behaviors within 1 year before registration in the intermediary market.

III. One recorded serious bad credit behavior within 2 years before registration in the intermediary market.

IV. Any recorded general or serious bad credit behavior between the registration in the intermediary market and before the signing of the intermediary service contract.

回避情形

Avoidance Situations

（一）参与同一项目采购的不同中介服务机构法定代表人或实际控制人为同一人的；

（二）中介服务机构的法定代表人或实际控制人和委托人单位法定代表人或者项目负责人有配偶、直系血亲（含拟制血亲）、三代以内旁系血亲或者近姻亲关系的；

（三）其他应当回避的情形；

I. The legal representatives or actual controllers of different intermediary service agencies participating in the same project procurement are the same person.

II. The legal representative or actual controller of the intermediary service agency has a marital, direct blood (including presumed blood), collateral blood within three generations, or close in-law relationship with the legal representative or project leader of the entrusting unit.

III. Other situations that should be avoided.
